Framed, Damned, Acquitted: Dossiers of a ‘Very’ Special Cell
Abstract.
The cases reveal deep-seated and systemic malaise in the criminal justice system owing to which fabrication and frame-ups of innocents, identified and targeted mostly on communal basis, has become routine. The cases cited in the report only justify the demand for a National Commission of Enquiry to document and investi-
gate the number of such cases across the country.
A comprehensive rehabilitation package, including assistance in education and occupation, should be devised and announced for those wrongfully incarcerated on false charges.
There is a need also to seek a fresh perspective from judgements of the Delhi High Court and cases such as Tasleema Versus State of Delhi and Prempal Versus Commissioner of Police that have laid down terms of compensation to be awarded to victims of false prosecution.
All the officers of investigating agencies against whom the courts have drawn adverse comments and inferences and who are responsible for prolonged incarceration of innocent citizens must not only be suspended but proceeded against by taking disciplinary action. Certain cases also call for prosecution especially when the law has been circumvented in order to invent cases against innocents. There is also a case for bringing investigating agencies under the purview of Parliamentary oversight.
