THE DECISION TO AWARD PUNITIVE DAMAGES: AN EMPIRICAL STUDY

ABSTRACT Empirical studies have consistently shown that punitive damages are rarely awarded, with rates of about 3 to 5 percent of plaintiff trial wins.
